Dear John,
Thank you for your letter of August 6, on points raised in the debate of July 4. If after all this time you can’t say whether any elderly dependents have been given leave to enter since the latest change in the Rules, my suspicion that there have been none is strengthened.
The hypothetical example you give ends with the phrase “and other relevant criteria are met”. One of the criteria is that the applicant ‘can, and will, be maintained adequately... without recourse to public funds’ (Rule 317(iv)). The only way I can imagine this 70-year old couple being able to demonstrate that they will not access NHS services would be to obtain medical insurance for private health care, and since the wife is in such poor health that she can’t even perform everyday tasks for herself, the cost would be astronomical.
Why don’t you come clean and admit that Rule 317 amounts to a total ban on elderly dependent relatives?
